If your Mother ever told you to always wear clean underwear in case you're in an accident, she was right. That advice has saved face for countless now-adults who developed good habits from Mom's words of wisdom.
But let's think about this for a bit: If my wife and I are in an accident (let's think positive and say we're only incapacitated), I might be glad that I didn't grab the boxers I only wore for 20 minutes after my shower the night before. And my wife would probably be glad she changed out of her favorite but well-worn tee shirt before we left the house. We all know, though, that this isn't really what the admonition to wear clean underwear is about. It's about thinking ahead to plan for the unthinkable.
I love my kids, and to think that the Police would arrive at my house after an accident, find a babysitter with no legal instructions for what to do with my children "RIGHT NOW" and be forced to hand them over to the foster care system is unbearable to consider. We would want my wife's parents, who are local, to care for the kids until we mend or... well, you know.
My children are lucky. I'm an attorney whose mission it is to make sure this never happens to any child. And I'm in good company. Fellow Personal Family LawyerTM, Alexis Martin Neely, has written a new book called - you guessed it: Wear Clean Underwear: A Fast, Fun, Friendly - and Essential - Guide to Legal Planning for Busy Parents. This book shows how easy it is to document your instructions for the permanent AND short-term care of your children and that your wishes are carried out, if you can't be there.
Tuesday, she was featured on the TODAY SHOW with Ann Curry discussing the critical missing pieces that parents sometimes assume are handled by having a Will. Parents with minor children need to understand that having a Will is NOT enough!
Check out the replay below for Alexis' segment on the TODAY SHOW, and if you or someone you know has not made proper provisions for your kids if something were to happen to you, then, buy the book, call me to schedule a consultation to go over your plan...just do something to make sure your kids NEVER spend one minute in the hands of strangers and a court system who does not know you or your kids.
